One proposed solution could be to make a distinction between simple pre-recorded messages on the one hand, and interactive automated calls on the other.

After all, VoiceXML was designed specifically to enable interaction between callers and automated systems. And it seems clear that the FTC's biggest problem with pre-recorded calls is the perceived inability of a consumer to quickly and easily exercise his Do-Not-Call rights while on the same call.

We need to convince the FTC that VoiceXML-based automated calls *can* offer consumers a quick and easy way to opt-out of future calls from that company.

Clearly a second solution (additive) is to make sure that web- and email-based opt-ins are allowed. Requiring an actual fax or written letter is just not practical.
